Introduction

10&8 Partners LLC (“Company” or “We” or “Us”) respect your privacy and are committed to protecting it through our compliance with this policy. This policy describes:

  • The types of information we may collect or that you may provide when you download, install, purchase, register with, access, or use the GolfNut application (the “App”), as well as the types of information we may collect or that you may provide when you visit the website at golfnutapp.com (the “Website”); and
  • Our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies only to information we collect in this App, and in email, text, and other electronic communications sent through or in connection with the App, as well as the Website.

This policy DOES NOT apply to information that:

· We collect offline or on any other Company Apps or websites, including websites you may access through the App.

· You provide to or is collected by any third party (see Third Party Information Collection section below)

· You provide to or is collected by a Company “sponsor”, namely, a third party upon which users of the App may choose to redeem a gift card earned through the App (hereinafter referred to as “Sponsors” ).

Sponsors and other third parties may have their own privacy policies, which we encourage you to read before providing information on or through them. This privacy policy does not cover any information you provide to or is collected by Sponsors or other third parties.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use the App. By downloading, registering with, or using the App, you agree to this privacy policy. This policy may change from time to time. Your continued use of the App after we revise this policy means you accept those changes, so please check the policy periodically for updates.

Information We Collect and How We Collect It

We collect information from and about users of the App:

  • Directly from you when you provide it to us,
  • Automatically when you use the App.

Information You Provide to Us

When you download, register with, or use the App, we may ask you provide certain information:

  • By which you may be personally identified, such as name, postal address, email address, or telephone number, or any other identifier by which you may be contacted online or offline] (“personal information“).

This information includes:

  • Information that you provide by filling in forms in the App. This includes information provided at the time of registering to use the App, entering into sweepstakes or contests sponsored by Company or selected third parties, signing up for special offers from selected third parties, sending Company an email correspondence, posting material, reporting problems with the App or Website, submitting your payment information when ordering products and/or services within the App and/or Website.
  • Records and copies of your correspondence (including email addresses and phone numbers), if you contact us.
  • Details of transactions you carry out through the App or Website and of the fulfillment of your orders. You may be required to provide financial information before placing an order through the App or Website.
  • Information about your use of the App services, including video viewing, sweepstake participation, and search queries within the App.

You may also provide information for publication or display (“Posted“) on public areas of the App or the Company Website (collectively, “User Contributions“). Your User Contributions are Posted and transmitted to others at your own risk. We cannot control the actions of third parties with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

 Automatic Information Collection and Tracking

When you download, access, and use the App, it may use technology to automatically collect:

  • Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App, including location data, and other communication data and the resources that you access and use on or through the App.
  • Device Information. We may collect information about your mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information, and the device’s telephone number.
  • Stored Information and Files. The App also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.
  • Location Information. The App does collect real-time information about the location of your device.

If you do not want us to collect this information, do not download the App or delete it from your device/you may opt out at any time by contacting us at admin@golfnutapp.com. For more information, see Your Choices About Our Collection, Use, and Disclosure of Your Information.  Note, however, that opting out of the App’s collection of location information will disable its location-based features and may disable other features as well.

Information Collection Technologies

The technologies we use for automatic information collection may include:

  • Cookies (or mobile cookies). A cookie is a small file placed on your smartphone. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your smartphone. However, if you select this setting you may be unable to access certain parts of the App.

Third-Party Information Collection

When you use the App or its content, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties may include:

  • Advertisers, ad networks, and ad servers
  • Analytics companies
  • Your mobile device manufacturer
  • Your mobile service provider

These third parties may use tracking technologies to collect information about you when you use the App. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

How Do We Use Your Information?

We may sell, rent, or lease your personal information to anyone. Further, we may use information that you provide to us or that we collect automatically for various purposes, including:

  • To administer, operate, and improve the App and Website;
  • To provide you with contents of the App and Website, and any other information, products, or services that you request from us;
  • Notify you when there are updates to the App, and of changes to any products or services we offer or provide through it;
  • To respond to an email, inquiry, or request sent by you;
  • To process a transaction, such as a purchase of Company goods or services;
  • To communicate with you, and to provide you with information you request or that we think may be of interest to you. You may opt out of such communications at any time by following the instructions in each communication;
  • To enable trusted third parties to provide products or services on your behalf or that you have requested, and to determine general statistics regarding use of the App and/or Website. Unless we tell you differently, these companies may only use the personal information we provide them as necessary to assist us, unless they have your consent and these companies are required to maintain the confidentiality of your information;
  • To our subsidiaries and affiliates;
  • To prevent fraud and to ensure the safety and security of the App and Website;
  • To comply with applicable legal obligations, such as responding to a subpoena or a court order, or to protect our rights;
  • To fulfill any other purpose for which you provide it;
  • With your consent.

In addition, information about users of the App or Website, including personal information, may be disclosed as part of any merger, acquisition, debt financing, sale of company assets, or similar transaction, as well as in the event of an insolvency, bankruptcy, or receivership, in which personal information could be transferred to third parties as one of our business assets.

We may share aggregated, non-personally identifiable information about our users for a variety of purposes, including marketing and promotions. However, in these situations, we do not disclose any information that could be used to identify you personally.

Children’s Information

The App is not intended for children under 16 years of age, and we do not knowingly collect, use, or disclose personal information from children under the age of 16, either directly or via any website or online service. If you have reason to believe that a child under the age of 16 has provided personal information to us, please contact us at admin@golfnutapp.com and we will endeavor to delete that information from our databases.

Cookies

As you navigate through and use the App and/or Website, we may use automatic data collection technologies (i.e., “cookies” and similar technologies such as web beacons and pixels). A cookie is a small data file that is placed on your device when you access the App and/or Website. We use cookies to improve your access to the App and Website (for example, by storing your username so you can log in more easily), and to allow you to share App/Website content with social media platforms such as Facebook, Instagram, or Twitter. Cookies also enable us to track and target the interests of visitors to the App and/or Website, so that we can provide more customized content. Cookies can also be used to collect general usage and aggregated statistical information. Most browsers can be set to detect cookies and give you an opportunity to reject them, but refusing cookies may, in some cases, inhibit or preclude your use of the App and/or Website or their respective features. We generally do not use cookies to identify the users of the App and/or Website personally. More specifically, we use the following categories of cookies:

  • Category 1: Necessary Cookies. Necessary cookies enable users to use the App and/or Website and all of their respective features, such as enabling access to participate in sweepstakes and enabling access to secure areas of the website. Without these cookies, you may not be able to use all the features of the App and/or Website.
  • Category 2: Performance Cookies. Performance cookies collect information about how you use our App and/or Website so we can improve them for you in the future. For example, they collect information on which pages you visit most often and any error messages you may get. The information collected by these cookies is anonymous. They do not collect any information that can identify you personally.

Google Analytics

We use Google Analytics to collect information such as how often users visit the App and/or Website, what pages they visit when they do so, and what other apps or websites they used prior to coming to our App/Website. We use this information to improve the App/Website. Google Analytics collects only the IP address assigned to you on the date you visit the App/Website, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit our App/Website, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to our site is restricted by the Google Analytics Terms of Use. Links to Other Websites

The App and/or Website may contain links to other websites that we do not operate or control. For example, to help generate interest in the App and our Website, we may offer you the opportunity to share information via social media platforms like Facebook, Twitter, or Instagram. Please be aware that this policy does not apply to any such third-party website. will not apply to your activities or any information you disclose while using third-party products or services or otherwise interacting with third parties.

How Do We Keep Your Information Secure?

We may store your data on servers provided by third party hosting vendors with whom we have contracted. We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Among other things, we use the Secure Sockets Layer (SSL) Protocol, which encrypts any personal information you provide to us by scrambling it before it is sent to us from your device. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) security, integrity, and privacy of any and all information and data exchanged between you and us through the App and/or Website cannot be guaranteed.

How To Correct Your Information or “Opt-Out”

Please assist us in keeping your information current by notifying us of changes to your name, address, title, phone number or email address. You may correct your personal information or opt out of future communications from us (i.e., emails, text messages) by sending us a request to admin@golfnutapp.com. We will use our best efforts to remove your personal information from our systems within 30 days of your request; however, we cannot promise to remove you from any list or database we don’t control. More specifically, we do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI“) on the NAI’s website.

State-Specific Privacy Rights

Depending on where you reside and in accordance with applicable law, you may have additional rights related to the personal information collected from and/or about you, subject to certain exceptions and limitations.

Residents of California

Additionally, under California “Shine the Light” law (Civil Code Section § 1798.83), if you are a California resident, you have the right to request certain information regarding our disclosure of your Information to third parties for direct marketing purposes. If you request such information, please contact us at admin@golfnutapp.com with “California Privacy Rights” in the subject line. If you are a California resident, you may submit a request, subject to our verification of your identity, for us to delete personal information we have collected from you. In some instances, we may decline to honor your request where an exception applies, such as where we need to retain your personal information in order to complete a transaction with you.

If you are a California resident, you have the right to be free from unlawful discrimination for exercising your rights under the CCPA.

Under the California Consumer Privacy Act of 2018 (CCPA), we are required to provide you with lists of the categories of personal information we collected, sold or disclosed about certain California residents in the preceding 12 months, by reference to the categories enumerated in the CCPA. We may sell, rent, release, disclose, disseminate, make available, transfer, or otherwise communicate the above information regarding a California resident’s personal information for monetary or other valuable consideration.

Right to Delete

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions (the “right to delete”). Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

We will delete or deidentify personal information not subject to one of these exceptions from our records and will direct our service providers to take similar action.

Residents of Colorado, Connecticut, Virginia, and Utah

Colorado, Connecticut, Virginia, and Utah each provide their state residents with rights to:

  • Confirm whether we process their personal information.
  • Access and delete certain personal information.
  • Data portability.
  • Opt-out of personal data processing for targeted advertising and sales.

Colorado, Connecticut, and Virginia also provide their state residents with rights to:

  • Correct inaccuracies in their personal information, taking into account the information’s nature processing purpose.
  • Opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects.

Residents of Nevada

Nevada provides its residents with a limited right to opt-out of certain personal information sales. Residents who wish to exercise this sale opt-out rights may submit a request to admin@golfnutapp.com. However, please know we do not currently sell data triggering that statute’s opt-out requirements.

Changes to This Policy

We may update our privacy policy from time to time. If we make material changes to how we treat our users’ personal information, we will post the new privacy policy on this page and notify you by email to your email address specified in your account.

The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you and for periodically visiting this privacy policy to check for any changes.
